Mr M. Blackburn

Forham Vehicles plc

Lever Estate

Scarborough YO11 3BS

I look forward to hearing from you.

Please let me know if you wish us to complete your order or whether you would prefer to make other arrangements.

May I point out, with respect, that your contract with us has a standard clause stating that delivery dates would be met unless unforeseen circumstances arose, and we think you will agree that an industrial dispute is an exceptional circumstance. However, we understand your problem and will allow you to cancel your contract if it will help you to meet your commitments to your Greek customers. But we will not accept responsibility for any action they may take against you.

First, let me apologize for your order not being delivered on the due date and for the problems you have experienced in getting in touch with us. Both are the result of an industrial dispute which has involved our administrative staff and employees on the shop floor, and has held up all production over the past few weeks.

Once again let me say how much I regret the inconvenience this delay has caused, and emphasize that it was due to factors we could not have known about when we accepted your delivery dates.

The dispute has now been settled and we are back to normal production. There is a backlog of orders to fill, but we are using associate companies to help us fulfil all outstanding commitments. Your order has been given priority, so we should be able to deliver the dynamos before the end of this week.

Yours sincerely

Thank you for your letter of 20 June concerning your order (No. VC 58391), which should have been supplied to you on 3 June.

4. Case study

Suppose you are the Kim Guitar Factory in Seoul, South Korea and make electric guitars. One famous American company Giks Guitars wants you to produce some guitars with exotic appearance and good sound. Your company agreed to work with Giks. You’ve had some initial correspondence by fax and now you’d like to meet personally. You’ll have to negotiate several points of the contract. The purpose of the meeting is to a deal acceptable to both sides. To be ready for negotiations

follow these steps:

A) You have a list of questions to be answered by your partner. Study the correspondence you got from him and decide what information is absent

( yes “+”, no “-“ ).

Dear Mr. Foul

We are Giks Guitars a well-established company with an up-market image. Our company is interested in placing substantial order with you. Your company was recommended as one of the best producers of electric guitars. We would like to order the production of three models of guitars: Giks SG 1200, SG 700, SG 400. All of them should have experimental shape and advanced technical features.

We insist on producing these models in your own factory in other way the quality may suffer.

In case of positive outcome we would appreciate the delivery to be organized by June 1.

We hope to get positive answer because we don’t see such trustworthy producer on this market now.

We look forward to get information from you shortly.

Yours sincerely

B) The Director prepared some terms of the deal the partner might have objections about. Your task is to find suitable arguments to persuade the partner.

E. g: The Partner might object:

-  Guarantee (you offer 1 year he insists on 2-3 years)

-  Quality (you propose that 40% of the order to be manufactured by other Korean firms, your partner is against that)

-  Discount (you offer 3% , the partner asks for 6-10%), etc.

C) This time you have a list of conditions your company offers and the conditions the Partner wants to pare them and decide what conditions your partner: a) will agree b) agree partly c) disagree?
