2  Scope of the program and compliance with the internal university standards

The present syllabus is aimed at faculty teaching this course, their teaching assistants, and students of the degree program 03.0200.68 ‘Political Science’, master’s program ‘Political Analysis and Public Policy’ with the specialization in human rights and democratic governing studying the course “International mechanisms of human rights protection”.

This syllabus meets the standards required by:

•  National Research University - Higher School of Economics,

•  degree program 030200.68 ‘Political Science’, master’s program ‘Political Analysis and Public Policy’,

•  Master program curriculum as of 2012.

3  Course goals

The course “International mechanisms of human rights protection” has the following goals:

- to provide students with profound knowledge of existing mechanisms of human rights protection on international level, their functions, development, interrelation, effectiveness, advantages and disadvantages;

- to show the importance of international mechanisms of human rights protection in conflict prevention and resolution, restoration of justice, sustainable development, the rule of law and democratic governance;

- to teach master students to chose most effective and reliable instruments for particular cases of human rights violations, evaluate and manage risks, apply appropriate instruments in practice;

- to cultivate the skills of critical assessment of human rights protection on different levels and by different institutions;

- to assess needs and propose public policy actions aimed at improvement of existing human rights mechanisms on institutional and legislative level both internationally and domestically.

4  Competences

By the end of the course, the students are expected:

•  to have a knowledge of the basic human rights treaties, their scope and mechanisms of implementation; interrelation between international and domestic human rights standards and mechanisms of their protection; functions of international and national institutions of human rights protection, their advantages and disadvantages; basic documents of the controlling bodies of the UN and the Council of Europe, tests and approaches elaborated by the European Court of Human Rights in its decision-making; judicial practice of the Russian Constitutional Court and other courts on human rights; procedure for submitting complaints to international and national institutions of human rights protection;

to be able to analyze cases of human rights violations and propose mechanisms for restoration of justice; to identify cases of human rights violations an distinguish them from other legal disputes; to apply a balancing exercise in cases of competing human rights; to draft reports and policy papers as a result of fact-finding missions or analysis of complaints, cases, legislation for international and national bodies at their request;

to have skills to identify the jurisdiction of the human rights violation and bodies authorized to protect a particular right both on national and international level; to analyze the activities of the domestic and international bodies of human rights protection and their effectiveness; to analyze the compliance of state human rights policy with its international obligations and Constitution of the Russian Federation.

5  Place of the discipline in the structure of the educational program

This course is a professional one, taught in the first semester of the first year of Master Program ‘Political Analysis and Public Policy’ for the specialization ‘Human Rights and Democratic Governance’. This is an elective course that welcomes but does not necessarily require prior knowledge in human rights.

This course is crucial for mastering the degree program of students of a human rights specialization and is based on/linked to the following courses:

•  Theory and Philosophy of Human Rights in Globalizing World

•  Global Actors in Public Policy

•  International Relations & Governance in Global Security

•  Human Rights in non-Western cultures,

•  Academic-research seminar “Human Rights Monitoring”.

It is also crucial for the students’ research papers and Master’s dissertation, especially for those who chose specialization in human rights and democratic governance.

7.1  Evaluation criteria

The interim control includes one essay as prescribed by the curriculum.

An essay is to be done at home. Sample topics are given in the course syllabus.

Within the frame of the course the student should demonstrate: the knowledge of theoretical and normative literature on the topics of the course, good knowledge of the literature from the main list and some knowledge of the literature given in the additional list; ability to analyze the material read; ability to summarize and to confront arguments, facts, figures and points of view given in the reading materials and lectures; to put the received information in the current national and international context; ability to discuss the topics covered within the frame of the course on a high level.

The final control is done in the form of the written exam. The duration of the exam is 60 min with the use of reading and normative materials (open book exam) or without (close book exam).

During the final control the student should demonstrate that the material, prescribed by the syllabus was learned fully as well as the ability to analyze and creatively interpret the information received, to demonstrate the ability to identify the jurisdiction of a particular human rights violation, mechanisms of human rights protection on national and international level competent to review information and to take action with regard this violation, the ability to analyze actions and decisions of human rights protection bodies and state policy in the sphere of human rights.

The presentation of the student on the exam should be clear precise and comprehensive. It should cover substance of the question and demonstrate a student’s understanding of a vaious aspects of the problem.

Week 4. The ICCPR Human Rights Committee: decisions’ analysis

On the first meeting students choose the country on the example of which they are going to study topics of the course. Through the recommendations of the various UN bodies with regard to these country students will analyze political and human rights discourses.

On the seminar dedicated to the analysis of the Human rights Committee decisions each student will choose several Committee’ decisions against the country he/she represents and will analyse them. The main emphasis should be made on the international standards on the particular rights protection and logic of the decision motivation. This analysis will later be also used for the comparison with the standards and logic elaborated by the European Court of Human Rights.

Week 5. Alternative reports – aims and targets, specifics of the submission and presentation

On the seminar dedicated to the alternative report-writing and presentation each student will study state and alternative reports to the various UN bodies on the chosen country. He/she will draft an alternative report style submission on one human rights issue basing on the reports read and up-to-date information. This submission should be presented in class in accordance with the rules of reports presentation to the auditory which will play the roles of Committee experts.

9  Образовательные технологии

The course is taught with the use of interactive techniques. Students are expected to analyze the human rights situation in the chosen country, work on the UN bodies on/in the country, coherence and logic of the approach etc and to deliver their reports within the frame of the seminars. Students will also participate in the “drafting and presentation of the alternative report” exercise. Within the frame of the European Court of Human Rights part of the course the drafting of the application to the European Court is envisaged by the course syllabus.

The course is taught by the staff-members of the department, who have a considerable experience of work with the national and international mechanisms of human rights protection. The invitation of the representatives of the Russian human rights sector working with the international human rights protection bodies to talk on their experience is possible.

On the first meeting students choose the country on the example of which they are going to study topics of the course. Through the recommendations of the various UN bodies with regard to this country students will analyze political and human rights discourses.

11  Порядок формирования оценок по дисциплине

The teacher evaluates student homework and essays they have written. The grades the students got for homework and essays the teacher notes down into the work sheet.

The resultant grade (10-marks scale is used) for essays is determined as Oessay.

The resultant grade for current check consists of a student results in the following way:

Оcurrent = 0,5Оhomework №2 + 0,5·Оessay

The final control is performed as an exam. The grade for the final control forms 50% of the resultant grade for the course.

During the final control the student has to demonstrate that he/she has entirely adopted the prospected material (knows basic concepts, uses correctly the terms, knows standards, can put gathered data into social and political contexts and so on), is able to analyze and comprehend information he/she got in a creative way, can evaluate easily and quickly a practical situation, possesses skill to explain studied issues.

The resultant grade for the final control (exam) is formed in the following way: Оfinal = 0,5·О exam + 0,5·О current, where Oexam - the grade the students gets during exam itself.

During the repeating of the exam the student is not provided with the chance to obtain additional mark to compensate the grade for current or intermediate controls.

Final control grade which is the resultant grade for the course goes to certificate of degree.
