1  Область применения и нормативные ссылки / Scope of Use

The present program established minimum demands of students’ knowledge and skills and determines content of the course.

The present syllabus is aimed at department teaching this course, their teaching assistants, and students of the degree program 030200.68 ‘Political Science’, master’s program ‘Political Analysis and Public Policy’, studying public policy analysis.

·  Curriculum of the master’s program ‘Political Analysis and Public Policy’ as of 2013.

2  Цели освоения дисциплины / Learning Objectives

-  After having a brief survey over various theories of human rights (giving special attention to еру contemporary sociological theories of human rights), we highlight their many unresolved tensions to explain why the practice, and not just the theory, of human rights matters.

-  The history and the context of institutionalization of human rights as a branch of international public law following the two world wars would explain the specifics of Human rights, its place among other branches of International Public Law (International Humanitarian Law, International Criminal Law), its advantages and its limits.

-  We then analyze the concrete international mechanisms of Human Rights protection, including the variety of the UN system of HR protection and various regional systems in a comparative overview. Specific focus will be made on the European system of human rights protection as being one of the most successful and effective mechanisms the duty to respect of which is granted to the international judicial body. This will also include a study of a role of the European Union as a center of legal and practical development of human rights protection that expands its effect far beyond the European borders. The so-called normative power of the EU is also a significant factor in international human rights sphere.

-  After having analyzed the theoretical part of human rights we then cover the substance of human rights, including not only the so-called fundamental rights (the right to life and prohibition of torture) but also other civil and political rights, such as fairness of judicial process, right to private and family life, freedom of expression and of association. This would also include some very specific rights, such as women rights, right to a healthy environment, protection of human rights in context of fight against terrorism, right to self-determination and others.

-  Ultimately, we attempt to assess how globalization and development is impacting human rights today, and the power (if any) that human rights have to shape the unfolding process of globalization and the institutions sustaining it. This would include analyze of several successful/unsuccessful human rights campaigning, including the environmental campaigning, campaigning for LGBT rights and others.

3  Компетенции обучающегося, формируемые в результате освоения дисциплины / Students’ Competences

By the end of the course, the students are expected to:

•  Know the major concepts of public policy and social discourse, as well as human rights theories;

•  Be able to discuss and reproduce these concepts and theories, be able to find relations between them and analyze them;

•  Be able to recognize important human rights problems, analyze them and suggest possible ways of solving them;

•  Be able to apply those analytical tools to various stages of policy process and to various institutions, that define a framework of policy process;

•  Be able to distinguish between infringements of law and human rights violations;

•  Be able to identify targets, decision-makers, benefactors and other actors involved into human rights issues, their motives, strategies and methods;

•  Understand who gains, and what are the motives, for framing particular issues as human rights issues;

•  Understand to what extent cultural differences in the conception of human rights affect the universality of those rights as philosophical values or legal obligations.

4  Место дисциплины в структуре образовательной программы/ The course in structure of the master’s program

This course is a foundational one, taught in the first and second semesters of the first year of master’s program ‘Political Analysis and Public Policy’ for both specializations: ‘Political Analysis and Public Policy’ and ‘Human Rights and Democratic Governance’. This is a core course that welcomes but does not require prior knowledge in human rights or political science.

This course is crucial for mastering the degree program on the whole and some of its courses in particular, including:

•  Global Actors in Public Policy

•  International Relations & Governance in Global Security

•  International Mechanisms of Human Rights Protection

•  Human Rights in the non-Western Societies, etc.

It is also crucial for the students’ research papers and master’s dissertation, especially for those studying human rights.
