WAIVER AND RELEASE FOR USE OF LINCOLN PLAZA TENANTS CORP. ACTIVITY ROOM

THIS WAIVER MUST BE SIGNED BY ALL PERSONS PRIOR TO USING THE ACTIVITY ROOM

I hereby request permission to use the Lincoln Plaza Tenants Corp. Activity Room. I understand that my presence in the Activity Room and my use of the equipment is solely at my own risk.

I understand that the use of the facility may involve great risk to persons with physical disabilities and certain medical conditions. I have no such physical disabilities and suffer from no medical conditions which would put me at such risk by using the facility. Further, I have not been instructed by a physician not to utilize the equipment nor to participate in any activities of the type offered by the Activity Room.

In consideration of making the facility available to me, on behalf of myself and my minor children using the Activity Room, I do hereby forever release, waive and discharge Lincoln Plaza Tenants Corp. and its present and future officers, directors, shareholders, employees, managing agent, agents and representatives, insurers and suppliers from any and all actions and causes of action, claims, demands or suits, whether known or unknown, for any form of actual, possible or consequential injury, damages or loss of any type or description arising out of or in any way relating to the use of or presence in the Activity Room, and/or the use of or proximity to the equipment, furnishings, fixtures or facilities therein, by myself or my minor children. I further waive, on behalf of myself and my minor children using the Activity Room, any rights of subrogation any person or entity may have to bring such actions, causes of action, claims, demands or, suits on my behalf or in my place.

I assume full responsibility for any injury or damages which may occur to me or to my minor children at such Activity Room or by reason of the use of the equipment.

I assume full responsibility for any loss of or damage to personal property of myself or my minor children which may occur in the Activity Room.

I have been informed and acknowledge that Lincoln Plaza Tenants Corp. will not provide any trainers or other supervision at, or in connection with, the Activity Room. I agree to use the equipment in the Activity Room without any such supervision.

I have neither requested nor received any express representations or warranties as to the use of the Activity Room equipment, and Lincoln Plaza Tenants Corp. does not make any implied representations or warranties with regard to the fitness or use of such equipment.

I have received a copy the Lincoln Plaza Tenants Corp. rules relating to the Activity Room and agree to comply with such rules and any amendments thereto.

I agree that any dispute or question concerning the use of the Activity Room may be resolved by the Board of Directors of Lincoln Plaza Tenants Corp., and the decision of such Board shall be, in all respects, binding upon me.

I have read and understand the above waiver and the aforementioned rules.
