R. v Jackson, Golding and Jackson
Court of Appeal (Criminal Division)
26 March 1982
Case Analysis
Where Reported | [1985] Crim. L. R. 442 |
Case Digest | Subject: Criminal Law Keywords: Administration of justice offences; Conspiracy Summary: Conspiracy; conspiracy to pervert course of justice; whether agreement "necessarily" involved commission of an offence Abstract: J1, G, J2 and W discussed W's plan to have himself shot to provide mitigation in the event of W being convicted of the burglary offence for which he was being tried. W was shot in the leg and permanently disabled. J1, G and J2 lied to the police about their whereabouts on the evening in question and concealed the identity of the person responsible for the shooting and the fact that W had arranged the shooting to mislead the court. Held, dismissing appeals of J1, G and J2 against conviction of conspiracy to pervert the course of public justice, that the plan did "necessarily" involve commission of an offence in the sense that if the agreement had been carried out in accordance with the plan there would have been commission of the offence referred to in the conspiracy count. It was no defence that the offence depended upon a contingency which may not have taken place, namely W's conviction of burglary (R. v Murray (Gordon Ellison) [1982] 1 W. L.R. 475 distinguished; R. v Reed (Nicholas) [1982] Crim. L. R. 819 considered). |
