" .. .You asked me to tell some words about the judicial system of the USA. Though I'm not a specialist in this field I'll try to do my best. The Supreme Court is the highest judicial organ of the US and it meets in the Supreme Court Building in Washington. lt's a beautiful building of white marble. Above the main entrance the words are written "Equal Justice Under Law". The Supreme Court consists of the Chief Justice of the USA and eight Associate Justiccs. They are all appoirtetl by the President and approved by the Senate. The Supreme Court has the right to declare unconstitutional any law passed by Congress or any order issued by the President. This right of veto is widely used to block the passage of any progressive bills. The USA is divided into eleven judicial circuits and each one is served with a Federal court of Appeals. As a rule the Court of Appeals sits with three judges on the bench. There are about ninety district courts in different parts of the Ui'. lted States. The district courts are the lowest ones in the Federal court system. Most of ; the criminal and civil cases are tried by these courts. The district court i s the only Federal court where trials are held, juries are used, and witnesses are called.

"...One more thing I'm going to tell you concerns the problem which faces our society now. I mean the problem of violence. The latest statistical data says that violent crime is rising constantly in this country.! know about it not only by newspapers reports. I've been robbed twice alredy and I'm afraid to leave my flat when it becomes dark. But even staying at home isn't a guarantee for safety. My old neighbour had been killed in his own flat and as usual the murderers hadn't j been found by the police. Violence has become an accepted way of life in j America. There are different explanations for this phenomenon. One of them is the possibility to buy any kind of weapons at gun shops everywhere in the US. The weapon is being bought not only by criminals but by law-abiding citizens too to protect themselves.

The growth of using drugs is one more reason. To buy drugs teenagars need money, so they try to get it by robbing, committing burglary or even murdering people. Another reason is the, propaganda of violence by mass media and especially television and-films.

Bribery stopped

It happened in America not long after its colonization by the Spaniards. A Spaniard stole an Indian's horse. The Indian however found the thief and demanded the horse to be returned to him, but the Spaniard refused to do it. The Indian applied to the court and brought witnesses who could testify that it was his horse. But the judge of the court was a bad man and used to take bribes from the parties who came to the court. The Indian knew this, and he invented a trick how to deceive the judge. Before going to the court on the day of the trial, he took a big stone and put it under his arm. The judge at once nooticed that the Indian had something under his arm and decided the case in the Indian's favour. He ordered the horse to be returned to the Indian and punished the Spaniard for that. After the trial, when the judge and the Indian were left alone, the judge asked the former what it was underhis arm and whom it was meant for. The Indian showed him the stone and told it was meant for the judge in case would had decided in the Spaniard's favour. It was a good lesson for the bad judge, and he gave up the habit of taking bribes.

The idea of fundamental human rights has a longe history, but as a subject of practical importance in terms of the protection of the quality and dignity of life of individuals, it has become of greatly increased significance since the end of the World War II period.

The adoption by the General Assembly of the United Nations of the Universal Declaration of Human Rights in 1948 has been followed by several international conventions of which the most significant are the International Covenant on Economic, Social and Cultural Rights, and the International Covenant on Civil and Political Rights, signed in 1966.

Although these international instruments have varying procedures for ythe protection of human rights, the substance of the rights protected includessubstantial common elements and, expecially in the realm of civil and political rights,'the developing case law of the European Convention is likely to become of increasing significance not just to the development of a European jurisprudence of human rights, but to a whole new development of an international jurisprudence on the subject.

Pete is preparing his report

Pete is going to participate in the international conference devoted to the problems of human rights. The theme he has chosen for his report is "The concept of human rights today". And this is what he has created.

The evolution at the national and international level has resulted in a modern concept of human rights which is built on but is also diffrernt from, natural law philosophy of previous generations.

Human rights must today be understood as those rights which are contained in the international instruments: the Universal Declaration and the International

Covenants, as well as the regional human rights conventions.

The notion of human rights is intimately linked to the notion of "State". Only in the context of an organised society with organs of authority does the notion of human rights make sense. The concept refers to the relationship between the individual and the State: the freedoms the individuals should enjoy, their right to legal justice, their rights to political participation, and their claims on the State in terms of satisfaction of basic needs and an adequate atandard of living.

The Constitutional Protection of Human Rights

The dignity and rights of man, a dominant theme in the political philosophy of the 18th century, flowered into practical significance with such instruments as the Virginia Declaration of the 1776, the American Declaration of Independence 1776, the French Declaration of the Rights of Man and of the Citizen 1789 and, of more lasting importance, the series of Amendments to the United States Constitution adopted in 1791 as the American Bill of Rights.

The constitutional settlement in the United States and the attached Bill of I lights provided a model for the protection of human rights. For many years this US model stood almost alone, but now the overwhelming majority of world stat have a written constitution providing checks and balances against the abuse of authority and enshrining in one form or another fundamental rights and liberties of individuals. There is no one some states the fundamental rights and liberties are protected within the Constitution other states a Bill of Rights is annexed to the Constitution subject to the same overriding primacy as the Constitution yet other states, fundamental rights are guaranteed by a Basic Law, falling short of the constitution itself but remaining paramount over the ordinary legislation of the state.

One of the earliest systems of law of which we have knowledge is the collection of laws, known as the Code of Hammurabi, the Babylonian king, which was carved in stone about 1900 B. C., and which can be seen in the British Museum in London. Another early code is the code of Hebrew law, contained in the Book of Exodus in the Bible.

In Greece each city state had its own law. Some laws were common to many states, such as the laws relating to family the seventh century B. C. the Greeks began to put their laws into writing. About 594 B. C. Solon, the famous Athenian lawgiver, provided a new codeof law. The Athenians did not consider it necessary to have legal experts for non - criminal a civil case the verdict was given by a jury, which might number anything from 201 to 2,500. The members of the jury listened to speeches made by the persons who had brought the case before them, and by their friends. Barristers were not allowed, speeches were sometimes prepared by professional speech - writers.

Computers catch criminals

Chief Inspector Harstenv talks about ways in which computers can help the police fight crime."Members of the public often think of detective work as fast and exciting when most of it is slow and boring. For example, a detective on a stolen car case may have to check through long lists of information, and in the time it takes him to do this the thief may well escape. With the new National Police Computer we are now able to find out details of car ownership and driving licences in a fraction of the time it takes by traditional methods. We are also developing systems of storing fingerprint information in computers and even informaltion about people's appearance. It's possible to work out codes for visual details aid to link a computer with a videotape recorder (VTR). Then, instead of looking through ' books of photographs we'll be able to ask the computer to sort out the right ones, and see photographs of suspects flashed across a VTR police work speed is often essential, so computers are ideal for helping us catch criminals. The only problem is that we now have a new kind of criminal — the very clever man who knows how to make huge sums of money by cheating a computer, and he is difficult indeed to catch."

Gregory Martin walked out of the photo shop and hesitated in the warm morning sun. He took the photos that he had just picked up out of the bag and flicked through them At first glance they all seemed clear and bright.

He was putting the pictures into his back pocket when a tall thin policeman approached him.

"Excuse me," said the policeman." You're Gregory Martin, aren't you?" Gregory stroked his bushy moustach nervously and took a step backwards. "That's right. The policeman put his hand On Gregory's sleeve. "Then you won't i lind coming down to the police station with me, will you?" he said. Gregory coughed and shuffled his feet. "What have I done?" he asked."You know what you've cone.

Someone saw you leaving Fleming's grocery store in the middle of the night, and. the next morning Mr Fleming was missing a great deal of money." "Thet's ridiculous!" Gregory said. "I haven't been to Mr Fleming's shop in months. When exactly did this robbery take place?"

"Five nights ago. Now, are you ready to come down to the station with me?" Gregory stepped backwards and pulled the pictures out of his pocket. "Look," he said. "I wasn't anywhere near the store five nights ago. I wasn't even in the country. I was on holiday, and these pictures will prove it."

The policeman looked through the date of photographs. "There are no calendars in them, so we can't tell the date. Wait a minute. What's this? Here's a picture of you. Hmmm, a very nice picture.

"That's right. That was my last night. The night you say I was in Mr Fleming's store. My friend Franz took that picture. So you see, I couldn't have committed the robbery."
